Proper peed off

Hi all just to let u no i sent away for my shotgun license last otober waited and waited got my FEO

round done all the checks he said it was all ok. Then i just had to wait for my certificate to come

through the post waited and waited again abd then yesterday i reseved what i thought was my certificate

only to open it to it sayin i had been REFUSED my face dropped i had a gun cabinet a gun lined up bag belt waistcoat the lot so i read thru it and due to some trouble i had in 2007 he thought i was a danger to the

people and peace so i rang u and had a word they want me to re-apply in 12months without being involved in

the police i said mate iv bin out of trouble for the last 4years whats 12months gonna change he said actually its

only 10 months ive got to wait then hes said its only 8 months because of when i handed it in in october im propra

gutted lads ok so i can do some shooting with my uncle and the seasons near the end so i shud have it by this season coming they told me i can apeal whats ur virdict on it please thanks BIGASH .

Gutted for you mate! Just wondering about the trouble you were in? Was it violence? As they could be cautious about someone with a violent past, tell me to mind my own if you like just curios as I have been in trouble myself

No mate not violence i was walking down from my house to show my grandad my air rifel i bought the old bill stoped

me questioned me arrested me because they said the air rifel was loaded and they thought i was trying to shoot the footballers i onistly wernt i neva got it out the case but thats what there like anyway down the station they told me it was 19flb and i needed a firarms license i neva new it was that powerfull but thats why they wont let me have it till 8months because that adds up to 5 years without being in trouble so i just gotta wait my FEO said it would all be ok tho and he even said iv give certificates to people with far worse but it must be just me lol

Lol, I've uming and arhing weather to send of for mine but I got arrested at 14. Then 15 for smoking pot both just cautions and I'm 25 now but at 16 I was arrested and convicted of possession of a lock knife, not using it in any way just bought it got stoped searched and night in the cells then of to court! Got cabinet up and gun on my dads cert so fingers crossed they will realise I was just a stupid kid but hey we will see atb ant

Id send off for it mate all they told me was they like u to have a clean slate for 5years so i thinck ur be ok mate i was propa angry yesterday when i found out lol but like my uncle told me he said it dosnt change anyfin cus i was shooting with him anyway without my own certificate so i just need to wait but when its all going right then that happens its propa head doing but hay i just gotta wait 8months ent that long LOL

That's a bit daft, if they were going to refuse you for that why not check it out BEFORE paying an FEO to come give you a home visit :s

LOL thats what i thought like i said my FEO said everything was ok and i shud get my certificate in 3weeks 6 the latest after that ring him if it dosent arrive then bang i get REFUSED and gotta wait 8 months .

couple of things you should have done my friend,,,firstly you had a right to see them test the rifle power and to see the gear they used.secondly if it was not cocked or a pellet in the port they can not do you for carring a loaded weapon,,,how old were you when you were stopped,,,,lastly with all the HAC stuff going on they are all getting tough Derek Bird had some convictions from years before he did what he did and the HAC wanted to know how he could be granted a certificate with the convictions he had,,,,,so today to get FAC/SGC you have got to be mother superior you cany have even looked in a shop window wrong all you can do is keep your chin up and try not to let the situation get you down the last thing you want is another police visit.

Its not always the case that the guy who does the home visit is the guy who has the final say.

 

The person who did the home visit may well have been the fire arms enquiry officer (feo), He may not even get to see the result of the PNC/CRB checks.

 

I dont know whether they do the checks before the home visit or after, Obviously it would make sense to do them before as this would save a lot of wasted time.

 

However you do have to declare any offences on your application form, as this gives them a heads up to look at your file before doing a home visit.

 

It just seems to be a very unfortunate thing that has happened and sounds like they are sticking to the letter of the law on past offences on file.

 

Atleast you can apply again in a few months.

I would put it in air gun ant. Not been in trouble for 9 years. Only trouble was as a juvenile. Now in employment etc should demonstrate a change in attitude.

 

To the OP - do you really think a refusal due to a firearms offence 3/4 years ago is unreasonable?

Ash, it might be worth getting hold of whichever shooting group is your choice, as they will be able to advise if an appeal might be worth considering, and most of the insurances cover legal costs. I'm assuming you are a member of one of the shooting associations.

 

It does sound a bit petty. How is 8 months going to make any difference? I would think that if they've said they'll be happy to issue it in 8 months (did you get that in writing btw?) then they'd have trouble claiming they thought you were a danger, which is really the only way they can refuse the issue.

 

I'm fairly sure they're on dodgy ground anyway, as you weren't imprisoned. Effectively they are treating you as if you have been sentenced to a term in prison of less than 3 years but more than three months. Unless you were given a suspended sentence then this isn't the case. Of course it being a firearms offence won't help your case, however if you were young when the offence was committed then that will play in your favour.

 

Of course, you were lucky not to get a custodial sentence for posessing an unlicenced firearm, it's up to 5 years! But if they didn't, then I can't understand how they can treat you as if you had.

 

Of course, if you'd been imprisoned, you would have been banned from using ANY guns until the 5 years was up, even sub 12 ft.l air rifles, but still seems a bit arbitrary for them to refuse to issue in those grounds.

 

Like I said, have a word with your shooting organisation and see if they think you have any chance at appeal. Without knowing all the facts we can't really advise you much further!

Ok mate thanks for that it really helped just to let u no they told me on the phone i had to go 8 months without being involved in the police then i can reapply and he said it should all be ok . But i will deffinatley see about appealing thanks
