airgun confiscated

ok maybe a little different, arm response and all for me, but got mine back did not test them, turned out that even police dont know all the rules and regulations about air guns, thats a fact. one thing tho is if your on permission, and have with you consent, then nothing will happen. i always ring first get the reference no now,, keeps all happy. be warned let your mouth go , then your knackered. 1) Why did the police stop you?

2) What made the police suspicious or why did they have cause to remove the rifle?

4) I doubt the police will actually ever test the rifle but if they do we are in the middle of the holidays and most back office staff will be on holiday, so I would suspect a good couple of weeks.

 

In the first instance if there was no reason to stop you and you were not causing concern then to be honest the police didn't have the right to remove your property, you are innocent until proven guilty but there is nothing written in law to give the police the power to remove your rifle on the off chance it is over the limit. If that was the case the police could come and search any of our homes on the off chance they might find something illegal. I suspect that you would have been up to no good or that there is more than meets the eye here.

If you don't have any receipt or anything to prove the general condition of the rifle, then expect to get the rifle back in poor condition. Personally, I would call the HQ and talk to someone, ask them for a full and detailed report of why the rifle was removed, with a crime or incident number. Explain that it is your intention to submit an insurance claim should the rifle be damaged and that you need all of this information. I'm guessing that as a responsible gun owner you do have insurance? If the officer in question has acted outside of the law, you will get a call to go and pick up your rifle. Should the rifle prove to be over the limit (if, and that's a big if; the police do test the rifle), you will have recourse due to the rifle being only five days old.

Another word of warning. If the police pull you at the side of the road and ask to see the gun give them the gun still in its case. DO NOT take the gun out of its case unless you are on your permission. I have known lads loose their airguns for doing just that. :thumbs:

in all my 15 years of hunting i had one air rifle confiscated and it was about 12 year ago because i was shooting ducks on the river next to a footpath and a report had been made to the police about it

but the only reason they took the gun was because the gun belonged to my cousin and i was borrowing it

 

i have just bought a new air rifle a couple of weeks ago and i walk to most of my permissions and have passed the police a few times and not once have they even looked twice at me

but i have grown up alot since losing my cousins gun and no longer do i shoot anything next to any footpaths

 

so maybe you were shooting somewhere you wernt meant to be?
