Cheers Dont know about constructive dismissal, sounds more like a case of victimisation and or harrasment to me if one individual is lined up. Most unions would have a field day with an employer who did this to someone. I am by no means an expert on this but my take is that, You cant make use of redundancy to target an individual only to make their roles no longer required and even then there are loads of steps required to do this the right way eg consultation periods/meetings etc. Best to contact someone like this www.acas.org.uk Edited: into english Edited December 9, 2010 by lapin2008 Quote Link to post Share on other sites

john h 37 Posted December 9, 2010 Report Share Posted December 9, 2010 It would be classed as an 'unfair dismissal', constructive dismissal is where an employee dismisses him/herself because theres been a fundamental breech of their employment contract,It's extremely difficult to prove at an Employment Tribunal so the success isn't good. When somebody is dismissed on the grounds of redundancy but the selection criteria are subjective/incorrectly marked or not consistent, valid or fair you have to go down the route of claiming unfair dismissal. The process is from the date of dismissal there is a 3 month window of opportunity to raise a claim at Tribunal. Before it gets there the Court wants you to appeal this with the employer, if unsuccessfull, contact ACAS 08457 47 47 47 and ask for PCC (Pre Claims Conciliation), if they can't help you (its a free service)then take it to Court. Some Citizens Advice Bureaus do offer free legal advice (when you can get an appointment) but the majority refer you to ACAS (the experts). Quote Link to post Share on other sites
