bikeral64 5 Posted October 7, 2010 Report Share Posted October 7, 2010 Has anyone got a Benjamin Discovery air rifle. I had mine given to me back in July this year for my birthday. Since then apart from using it to set up my new scope, it hasn't been fired in anger. This is due to the fact that the bolt kept jamming and it went back to the shop. They returned it after a month, only for it to jam again after only a few shots.Back to the shop it went again, this time it was sent back to the distributors, they have had it for a month also and still can't make up their mind what to do with it. I have asked for a replacement gun, but they seem to be reluctant to give me one. I just wonder whether this is a common problem with this gun, or have I just been unlucky. The shops answer was, Of coarse this is only a budget gun, so you can't expect too much. I expect a product to work whatever the price of it. I would value any comments you have. Quote Link to post

Honestly, your Rifle dealer sounds like a right twart. If you had it in July, it must still be under warrenty. Top of the range, or lower end, what they sell should be fit for purpose. Sound's like you have been more than co-operative waiting for them to rectify the fault. TELL them, its not fit for purpose, you either want a refund on the spot,or a new rifle, and dont take no for an answer, the law is on your side. If he was worth his salt, he would have already offered you that option, instead of making rediculous excuses. Good luck with it mate. Bill. Quote Link to post

It's now time for them to rectify it by offering a replacement or refund. Try and catch the dealer face to face when the shop is busy. matt_hooks 188 Posted October 7, 2010 Report Share Posted October 7, 2010 You say you were given the rifle, I'm assuming that a parent or similar bought it brand new and gave it to you direct? If that's the case, then it might help to take the actual purchaser along to have a word. Under the sale of goods act, they have to provide a product that is "substantially as described, of reasonable quality and fit for purpose" Your rifle fails two of those tests, possibly all three, as I'm sure he didn't describe it as "not working". You have the right to demand a replacement or refund. He can offer to try and fix the problem, and you can choose to accept, but that doesn't mean that if he can't fix it you have any less right to a refund or replacement. Don't let him try and fob you off with "it's the manufacturers fault". Your contract is with him, not the manufacturer, and it's his responsibility to rectify it. If you're feeling like pushing him a bit, tell him that as he's deprived you of the lawful use of the equipment, you are considering suing him. It's a bullshit suit, and wouldn't go anywhere, but if you say it with enough conviction you might just shake him into doing something. You've been more than fair with him, and given him far more opportunity to rectify the problem than you needed to, so it's time to start getting a little heavy with him. Tell him that if he doesn't rectify it within 7 days you will be filing papers with the small claims court to get your money back. Another avenue is if it was bought with a credit card. If the goods cost more than £100 then the credit card company are jointly liable with the vendor. I always try and put part of a big purchase on a credit card, even if it's only £2 or £3, as then you are covered by the credit card company if the vendor screws around! I can write you a nice persuasive letter if you want, that you can send to him. Just PM me if you want me to do that! Quote Link to post

I am now waiting for a letter that is being sent to me and the Gun shop, from the distributor who holds the gun at the moment. I will act according to what that says. In the mean time I have been into another gun shop that has also got this gun in stock, just to see if he has had any complaints from people he has sold one to. Unfortunately he hadn't sold one at all and was wishing he hadn't bought them in, as this gun had shown very little interest to his customers. I am getting a bit impatient now so soon it will be time to put the big boots on. Quote Link to post
Phantom 631 Posted October 7, 2010 Report Share Posted October 7, 2010 Sod waiting for the letter from them Time to go see the shop and let them know that unless they either replace or refund immediately, then they will be hearing from Trading Standards within a week. Also I think that you should name the shop so others won't make the mistake of giving them their money If you do decide to use Trading Standards, they will tell you to write to the company, explaing whats happened (Even though they know) and tell them that you want either a replacement, working item or a refund. Tell them they have 5 working days to respond to you by letter or phone (preferably by letter). TS will tell you to post the letter to them via Royal Mail Signed for, so that you get proof of delivery with a signature. If after 7 days,you have not heard from them, then take the proof and a copy of the letter into your local TS office (phone book for address) and if you have the proof, they will then act very quickly against the shop I often find that quoting the "Sale of Goods Act", as described by others above and the threat of a visit from Trading Standards (but you do have to be prepared to back up the threat) will nearly always get you what you want immediately Good luck Phantom Quote Link to post
