But without knowing the full story, it's hard to tell who was right. You say it ran across the burn. If i was on my farm and a strange dog appeared from nowhere starting fighting with my dog, and you couldn't see the owner, and i tried to seperate them and it snapped or went for me, well sorry it would get both barrels end of story. Like the one who told me his lurcher had been shot, even though it was on the outside of the field and not worrying sheep. Turned out it very much was in the field and was worrying sheep. The law is clear on this; a dog may only be shot (by a licensed and authorised person) if it is in the act of worrying livestock, and only then as a last resort. The police can also shoot dogs if they pose a significant risk to the safety of the public, and are dangerously out of control. No individual is allowed to shoot a dog unless it is within the law as above. If they do, they are committing the offence of criminal damage, and also firearm offences - both of which are serious. If you ever find yourself in this position, do not react with violence, no matter how angry you are. Phone the police immediately, and tell them what has happened, and add that you feel threatened by the actions of the individual concerned. Use violence against them and you will find yourself in court. Bruises heal, but the loss of your liberty, your pastime, a significant amount of money, and your reputation takes some getting over. Of course, if you are poaching, especially deer out of season, and your bull cross is out of control and damaging another dog, then you will have little sympathy from the courts. I couldnt say what i would do because i honestly dont know, but the emotion that would be brought out with that sort of incident would probably overide logical thought. If the dog was shot for worrying sheep then the man had every right to do so, and the dogs owner can kick up a fuss if he likes it will not bring back a dog he should have trained properly.
