Wxm 1,638 Posted December 25, 2009 Report Share Posted December 25, 2009 hi all i really need some advise. my daughter was bor april 05 and my name is on the birth cert. i was with the mother of my daughter up until my daughter was aprox 1, i paid money £100.16p a month since she was down (i have a duplicate book to prove this with my ex's or her mums signature on). as i said i have paid maint...ainance all the way and seen my daughter every weekend apart from a handfull (holidays, partys ect). march / april this year the company i worked for anounced there would be redundanceys and i was 1 of the handfull that was picked for redundancy. i told my ex just before i got redundant that i was getting made redundant and she cut me down from seein my daughter every weekend to every other. the day i got redundant i phoned CSA and told the what happened and i asked how much was i suppose to pay (maintainance) and they told me £5 a week (£20 a month). so as my ex dropped my little girl off and picked her up i told her i would double it and pay £40 a month. ... See More this was going ok until a few weeks ago when my ex picked my daughter up. she went home to her mum and filled her head with shite. now they have stopped me seeing my daughter and have told me to take it to court. i have spoken to my solis and he has told me my ex's mum has residance rights (not sure what this means) what are my rights?? what can i do?? and what are residance rights?? Since 1 December 2003, a non-married father registered on the child’s birth certificate will also automatically gain parental responsibility. As said, you still have rights of access but you will have to negotiate with the old bitch not the young one. (Not very Christmassy Ric...). Perhaps your solicitor could write to the grandmother? A few days away is no problem but you need to make damn sure she comes back. My sympathy to you today. After my marriage broke up my first Christmas without watching my little lass opening her prezzies under the tree, was pretty hellish. Chin up bro', and keep your legal beagle on the case.
