Cannyboy 34 Posted November 14, 2009 Report Share Posted November 14, 2009 just thought id put this up to see what people think, my misses had 2 horses turned out in 50 acres of grazing with 2 others 1 night we went up to feed them like she did every night only to find them gone. we found a rspca card laying in the field so gave them ring, they wouldnt say if they had them or not for 3 days we phoned local police and was told the rspca where in possession of them. we phoned solicitor and he in turned spoke to rspca and they confirmed they had them and that my 2 horses where fine but 1 of the other horses was in poor condition. we explained that that horse didnt belong to us and we supplied passports for our 2,this was 4 weeks ago now and in that time they have just put us off and given us the run around. then yesterday they phoned to say they are going to re-home all the horses because they cant trace the owner of the 1 they claim to be poor, if we dont agree with this then we have the option to take the rspca to court at a cost of betwean 5-10,000 and even if we won the day we still woulndt get our horses back if they had been re-homed just the value of them!! as you can imagine my misses is very upset about this and im so bloody angry! Are they above the Law?? they have not charged us with anything and they admit there isnt a problem with my 2 so how can they keep them!! we havnt got that type of money so they know they have won without us even having a chance to argue our case. Then contact as many papers as you can! explain what's happened and get them to run as big an article as you can! And if you know where they are take them back and hide them! while you fight it! fat_will 0 Posted November 14, 2009 Report Share Posted November 14, 2009 its thef there where 8 horses taken from well run horse feilds near me a few years back same story no warning or contact from police rspca or local concil a fuss was kicked up (travlers where blamed etc 1st) a local saw it where rspca but they still did not play ball for a month or so but in the end stock where brought back but no charges (legal wise) and no apollagey the reson given they where on conile land but local conicle would rather see it grazed and kept free from burnt out cars etc Quote Link to post Share on other sites
Cannyboy 34 Posted November 14, 2009 Author Report Share Posted November 14, 2009 yer thats the option we got to take out a possession order but to do that we have to pay solicitor min £500 to get it up and running but if they still refuse to return them it could cost anything upto £10,000 in court, they know not many people can afford to fight them so thats why they choose to go down this road. and its not there own money they fght with just silly sods who donate money thinking they really care about animals what a bloody joke!!! You don't have to pay the police to do their jobs, I'd suggest seeing someone first thing. If they try to fob you off or say it's a civil matter (you'd be surprised how even the police bow down to the non-existent 'power' of the arsepca), ask to speak to the chief constable. You'll not get them, but someone senior should hopefully know more about the way the law really lies, and take some action. Maybe speak to Clive Reese (I gave you his number above) and see if he wouldn't have a polite word with a senior officer, informing them of their legal obligation to act on a case of admitted theft! He's a good bloke, and I'm sure he'll do all he can to help. Don't take no for an answer, and if the police still won't play ball, I'd start ringing national newspapers in the front reception citing top brass' names until they suddenly decide they want to help Quote Link to post Share on other sites

There is no way that your horses should have been taken if there is nothing wrong with them. Was the other horse in a poor state? can you not contact the owner and tell them to sort this out? if you have passports for the horses go to the police and report them stolen, record or get in writing that your horses are in good condition, get your vet to write a letter stating that you cared for your horses, go to the police armed with evidence that they were well cared for and ask that the RSPCA prove otherwise or return the horses to you. speak to the help group and they will put you in touch with a solicitor that can help.
