UNFIT 0
Cocker...just to let you know...it doesnt have to be the officer who arrested you that has to de arrest you.....any other officer can de arrest you once you have been arrested. [it usually would be but not in allcases and as they all have the same powers it doesnt have to be] it sounds very much like an unlawful arrest, from what you have said, confirmed by the fact that the custody officer wouldn't authorise your detention...think you have a good case for unlawfull arrest and detention [as you were kept some time]...think it is still paid at about £1000 per hour you were detained!!! ATB dont want to get into any argument with you ,but if the arresting officer is still on the scene ,he has to be the one to de,arrest you .because he was the one that arrested you in the first place if there is no charge . cocker 2,654
hi poacher 3161, fortunatley for me i dont have any convictions for any poaching/poaching related offences, wildlife crimes, firearms, or anything along them lines, they would have knew this as they checked my records when they did the persons check, just before they arrested me, again fair play to them if i had previous convictions for poaching but i havent. which makes it even worse for them to arrest me on "suspition of poaching" cocker Edited October 18, 2009 by cocker Quote Link to post
J Darcy 5,871
Suspicion of having poached..or going to poach? I do not think it is posible to arrest someone for the "intention" of going to poach. But i could well be wrong. Like i have said earlier. Put an official complaint in and see what happens. The offficer will sh!t himself. I speak from experience....... Good luck....JD Quote Link to post

Cold Ethyl 63
Go to a solicitor for one theyre not allowed to handle your dog lol i know this through a recent incident theyre supposed to get a dog handler out form the sspca or rspca to take custody of the dog there and then from you.Theyre not allowed to transport non police dogs in their veichles either and you had no lamp no battery no furry things and no evidence of wrong doing so you could technically take them to court for all these things what would they have done if the dog had bitten them or something happened to the dog.You could say how stressed the dogs been and yourself etc over the inceident. pennine lad 0
Put an official complaint in. Then just see what happens. did any one ever tell you that you was DE,ARESTED ,before they let you go .if not and you was not charged ,you are still under arrest and should not be walking the streets ,you can get them in a lot of shit over this ,if you want to play them at their own game ,plus do them for wrongfull arrest .if you do take action ,you will find that they wont jump the gun so quick next time . i didnt hear the custody officer de arrest me come to think of it,, i might take it a bit futher, i think i will go and see a solicitor on monday, i really hadnt been poaching or anything, and i havent done anything wrong, so i think they made a wrongfull arrest. i have just had a phone call from my mate, and he told me that 3 other lads were also aprehended at thirsk early this morning, at bagby near the bottom of sutton bank, but they were only spoken too and then told to leave the area. get the solicitor to ask for the written report what happend ie the arresting officers note book ,and if it states they did not de arrest you ,then they are in deep shit from their superiours for not carrying out their job properly ,it might not sound much to u but take it from me they wont like it one bit . we were up dishforth with the dogs drivin along a lane got pulled over by the PIGS tried to arrest us all c....ts. checked all the moto out tried to take it at one stage we did nowt wrong we wernt on anyland at that time just driving. in the end they had no choice but to let us go. they said they had alot of trouble with lads poaching deer, in that area. just wonderd if anyone else has heard of this Quote Link to post
