Whilst this may appear to be a reversal of the usual burden of proof, technically the prosecution has already proven the case (prima facie) by establishing that a knife was being carried in a public place. If you are not, then this is an example of why everybody who owns a gun should be. In a public place a cap gun can be classed as a firearm, although unless you were threatening people with it, I think it unlikely that this will go any further. I have been training my dog with a starter pistol and long blanks on a public field. Someone complained (as they always do) luckiley though they complained at a parish council meeting and the lovely little old lady councillor with a filthy mouth who was telling me about it called the guy who complained a complete drama pr1ck :clapper: . I offered to attend the next meeting to explain that I wasn't doing anything wrong. Got home and made a phone call to the lancashire constab firearms dept, he confirmed that firing a bright orange pistol cap gun away from houses with a dog at heel and with several bright orange gundog training dummies being throw and retrieved constituted no risk to the public (he was laughing when he said this) and that I wasn't breaking any laws.... He did warn me though, that if the nosey old bugger had phoned the rozzers and mentioned the secret three letter word :secret: Gun :secret: they are obliged to pay an imediate visit with lots of big boys and bigger guns that fire and cycle faster than I can with a starter pistol Crazy, I'm not breaking the law yet I could theoreticaly still get shot This is crazy, and yet shows the total ignorance of the general public when it comes to gundog training. I read a year or so ago of a case involving two middle aged ladies who were out training their gundogs with a similar pistol, (thats the glowbright starspangled, couldnt look less like a real pistol unless you took the barrel off the thing). Anyway an ignorant idiot comes wandering across the field sees them and phones the police, who send the firearms unit to arrest the two middle aged ladies, who by the way have permission to be on the land and have permission to train their gundogs on the land as well. The upshot is that somehow succesful convictions are brought against both of these ladies although 1 appeals and subsequently sees the charges dropped. I have heard similar things involving Knives A landscape gardener convicted of carrying sharp gardening tools but subsequently freed on appeal (the judge issued a stern broadside to the police for even bothering to bring the case to court) how can one judge convict and another see common sense when given the same evidence ? Theres also the incident of the 50 year old woman who was caught taking a birthday cake to work for her collegues along with a kitchen knife to cut the thing up with. I could go on, but what i am trying to say is that the people whom this crazy legislation seems most effective against is the law abiding citizen who poses no criminal threat whatsoever, legislation always seems to legislate against the law abiding. Look at the law on handguns brought in as a knee jerk reaction following the dunblane tragedy, no one (except a select few, vets etc) can own or buy a handgun in the UK anymore, and yet handgun crime is now at a higher level then it was pre-dunblane. If anyone on here has ever been convicted of carrying a knife when they believe that they have had a perfectally legitamate reason for so doing i would urge them to appeal against their conviction in the hope of coming before wiser council, i would also suggest that if someone was offered a police caution that they refuse this as acceptance of the same is just an admission of guilt. sorry for the somewhat lengthy rant folks, but the seemingly random approach to the law in this country by the people who are supposed to enforce it makes my blood boil all the best fin and fur Quote Link to post Share on other sites
