    Probaly not ben prosecuted solely on a photo or write up. But if someone has been noted to have done this and someone decides to dig deeper on the matter then all small bits of info accumalated can soon mount up and then the person can be investigated further and possibly ending up with search warrant and search for evidence. So no your right but why put yourself in that sort of situation in the first place.
